Terms of Service

WHEREAS, Relativity Networks is an network and information provider. Relativity Networks provides access to the internet and storage space on its servers;

WHEREAS, Customer seeks to utilize Relativity Networks' servers for his/her own purposes;

WHEREAS, the parties acknowledge that Relativity Networks can make no guarantee that any given reader shall be able to access Relativity Networks' server at any given time.

THEREFORE, in consideration of the mutual promises contained herein, the parties agree as follows;

FINANCIAL ARRANGEMENTS
  1. At the end of the contract term, the contract will automatically renew for successive one (1) month periods indefinitely until canceled in writing or cancelled via the suppport portal.
MATERIAL PRODUCTS
  1. The Customer agrees that he or she acknowledges that a certain level of computer knowledge is required to operate a server. Customer agrees that it is not the responsibility of Relativity Networks to provide this knowledge.
  2. Relativity Networks makes no warranties for the service it is providing.
  3. Connection speed represents the speed of a connection to and does not represent guarantees of available end to end bandwidth.
PRODUCT STIPULATIONS
  1. Package pricing and details are subject to change. Customers affected by such changes will be notified no less than fourteen (14) days in advance by Relativity Networks.
  2. Relativity Networks is under no obligation to compensate Customer for downtime, whether the downtime be caused by Customer, Relativity Networks, or Relativity Networks' upstream providers.
  3. Customer agrees that payments are nonrefundable. For example, if Customer submits payment for three (3) months of service, service will be provided for three (3) months and will not be refunded if customer chooses to discontinue service with Relativity Networks mid-way through the term.
  4. Customer is responsible for keeping the security of their system up to date.
  5. Relativity Networks reserves the right to take any action upon servers it deems necessary at any time to protect the security and integrity of Relativity Networks' network.
  6. Customer is responsible for his or her own data backups. Relativity Networks will not be held responsible for lost data under any circumstances.
  7. Relativity Networks does allow IRC servers, pornography, and game servers on Dedicated and VPS services.
AGE
  1. The Customer certifies that he or she is at least 18 years of age, or have their parent or legal guardian act at the "Customer" in this contract.
INTERNET ETIQUETTE
  1. Users must not attempt to undermine the security or integrity of computing systems or networks and must not attempt to gain unauthorized access. This includes (but is not limited to) such things as Denial Of Service attacks of any kind.
LIMITED LIABILITY
  1. Under no circumstances, including negligence, shall Relativity Networks, its offices, agents or any one else involved in creating, producing or distributing Relativity Networks' Server service be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the Relativity Networks services.
LAWFUL PURPOSE
  1. Customer may only use Relativity Networks' Server for lawful purpose. Transmission of any material in violation of any Country, Federal, State or Local regulation is prohibited.
  2. Customer agrees that use of Relativity Networks' server for sending bulk e-mail will only be tolerated if the Customer can provide proof that they are following the CANSPAM Act.
TERMINATION
  1. This contract may be terminated by either party, without cause, by giving the other party 14 days written notice. Relativity Networks will accept termination by electronic mail. Notwithstanding the above, Relativity Networks may terminate service under this contract at any time, without penalty, if the Customer fails to comply with the terms of this contract, including non-payment.
INDEMNIFICATION
  1. Customer agrees that it shall defend, indemnify, save and hold Relativity Networks harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorneys' fees, ("Liabilities") asserted against Relativity Networks, its agents, its customers, servants officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by Customer, its agents, employees or assigns.
CONTRACT
  1. Revisions to this Contract will be applicable to previous Contracts.
  2. Revisions will be considered agreed to by the Customer.
